Welcome to Rusticgram. These Terms of Service (“Terms”) govern your access to and use of our website, mobile application, and services (collectively, “Platform”). By accessing or using Rusticgram, you agree to these Terms. If you do not agree, don’t use the Platform.

WHO WE ARE

Rusticgram is a digitization service that transforms your old photo prints into digital memories. We handle everything from pickup to scanning to digital delivery via our platform.

ELIGIBILITY

You must be at least 18 years old to use our services. By using Rusticgram, you represent that you meet this requirement.

ACCOUNT CREATION AND RESPONSIBILITIES

• You are responsible for maintaining the confidentiality of your account.
• You agree to provide accurate information and update it as needed.
• You are responsible for all activity under your account.

SERVICE USE AND ACCEPTABLE CONDUCT

Don’t hack, reverse engineer, or disrupt the platform.

• Don’t upload unlawful or offensive material.
• Don’t impersonate others or misrepresent your identity.
• You may not use Rusticgram to infringe on copyrights or intellectual property.

We reserve the right to suspend or ban accounts that violate these terms, without notice.

OUR SERVICES

We provide photo digitization and lifetime cloud access (within your account) to digitized images. Free plans are limited to viewing 5 unblurred images. Premium plans unlock full access, sharing, and offline options (with restrictions).

PRICING AND PAYMENT

• Rusticgram follows a freemium model.
• Free plan: View 5 digitized photos.
• Premium plans: Lifetime access at one-time or subscription-based plans (Monthly/Yearly).
• All payments are non-refundable unless specified under our Refund Policy.
• Rusticgram reserves the right to modify pricing at any time.

DATA USAGE, RETENTION, AND DELETION

• We retain your digitized photo data as long as your account is active.
• Profile deletion is free and removes access to your account and communications.
• Data deletion (digitized photos) requires a non-refundable INR 1999 data destruction fee, applicable to all users, including freemium.
• This deletion is irreversible. Once processed, no recovery is possible.

INTELLECTUAL PROPERTY

• You retain ownership of your original photos.
• By using our service, you grant Rusticgram the right to process and store these images solely to provide you with the promised services.
• We do not claim any commercial rights to your digitized images.
• Our platform, code, branding, and tools remain the property of Rusticgram.

SERVICE INTERRUPTIONS AND BUGS

• While we strive for 100% uptime, Rusticgram is a developing service and may experience outages, errors, or bugs.
• You acknowledge that there may be temporary disruptions.
• We provide support and patches where possible and appreciate your patience.

REFUNDS AND CANCELLATION

• Due to the operational cost involved in digitization, payments are non-refundable once processed.
• In rare exceptions, if no scanning or pickup has occurred, cancellations may be honored. Email team-rusticgram@rusticgram.com for review.

TERMINATION

• You may delete your account anytime through the app.
• We may suspend or terminate accounts that abuse or exploit the service.
• If we terminate your account for violation of the terms, no refund will be issued.

LIMITATION OF LIABILITY

• Rusticgram is not liable for any indirect, incidental, or consequential damages.
• We are not liable for loss of physical photos due to unforeseen events, though we take maximum precautions.
• Our maximum liability is limited to the fees paid by you in the last 6 months.

GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India. Any disputes shall be subject to the courts of Chennai, Tamil Nadu.

CHANGE OF TERM

We may update these Terms periodically. If changes are material, we’ll notify you through email or in-app. Continued use constitutes acceptance of the new terms.
