Welcome to Rusticgram. These Terms of Service (“Terms”) govern your access to and use of our website, mobile application, and services (collectively, “Platform”). By accessing or using Rusticgram, you agree to these Terms. If you do not agree, don’t use the Platform.
WHO WE ARE
Rusticgram is a digitization service that transforms your old photo prints into digital memories. We handle everything from pickup to scanning to digital delivery via our platform.
ELIGIBILITY
You must be at least 18 years old to use our services. By using Rusticgram, you represent that you meet this requirement.
ACCOUNT CREATION AND RESPONSIBILITIES
- You are responsible for maintaining the confidentiality of your account.
- You agree to provide accurate information and update it as needed.
- You are responsible for all activity under your account.
SERVICE USE AND ACCEPTABLE CONDUCT
You may not hack, reverse engineer, disrupt, or attempt to interfere with the Platform.
- Don’t upload unlawful or offensive material.
- Don’t impersonate others or misrepresent your identity.
- You may not use Rusticgram to infringe on copyrights or intellectual property.
We reserve the right to suspend or ban accounts that violate these terms, without notice.
OUR SERVICES
We provide photo digitization and lifetime cloud access (within your account) to digitized images. Free plans are limited to viewing 5 unblurred images. Premium plans unlock full access, sharing, and offline options (with restrictions).
SERVICE MODEL DISCLOSURE
- Rusticgram operates through a combination of centralized processes and trained partner-assisted workflows.
- Scanning may be conducted by authorized partner operators under Rusticgram governance protocols.
- By placing an order, you acknowledge that digitization may involve partner-operated workflows supervised by Rusticgram systems.
PHYSICAL ASSET HANDLING AND CHAIN OF CUSTODY
Rusticgram operates a documented chain-of-custody workflow for all physical photo assets submitted for digitization.
By placing an order, you acknowledge and agree that:
- Your physical media will be logged and tagged against a unique order ID.
- Assets will be transported by verified partners.
- Handling is conducted under internal operating protocols designed to ensure traceability and controlled custody.
- While we take commercially reasonable precautions to safeguard physical items, unforeseen circumstances (including but not limited to force majeure events) may occur.
Rusticgram’s liability for physical asset loss or damage is limited as outlined in the “Limitation of Liability” section.
PRICING AND PAYMENT
- Rusticgram follows a freemium model.
- Free plan: View 5 digitized photos.
- Premium plans: Lifetime access at one-time or subscription-based plans (Monthly/Yearly).
- All payments are non-refundable unless specified under our Refund Policy.
- Rusticgram reserves the right to modify pricing at any time.
DATA USAGE, RETENTION, AND DELETION
- We retain your digitized photo data as long as your account is active.
- Profile deletion is free and removes access to your account and communications.
- Data deletion (digitized photos) requires a non-refundable INR 1999 data destruction fee, applicable to all users, including freemium.
- This deletion is irreversible. Once processed, no recovery is possible.
DATA HANDLING AND ACCESS CONTROL
Access to customer data and digitized images is strictly role-based within Rusticgram.
- Scanning partners have visibility only into assigned orders.
- No partner has cross-customer access.
- Shared credentials are prohibited.
- Internal administrative access is restricted to authorized personnel.
We implement commercially reasonable technical and organizational safeguards to protect customer data.
INTELLECTUAL PROPERTY AND CONTENT RIGHTS
You retain full ownership of all original physical media and digitized images submitted through Rusticgram.
By using our services, you grant Rusticgram a limited, non-exclusive, revocable license solely to:
- Process, scan, and digitize your submitted materials
- Store and host digitized content within your account
- Deliver your digitized content through the Platform
Rusticgram does not claim copyright, resale rights, licensing rights, or commercial rights over your images.
We do not use customer images for public datasets, advertising, resale, or third-party AI training without explicit, separate consent.
SERVICE INTERRUPTIONS AND BUGS
- While we strive for 100% uptime, Rusticgram is a developing service and may experience outages, errors, or bugs.
- You acknowledge that there may be temporary disruptions.
- We provide support and patches where possible and appreciate your patience.
REFUNDS AND CANCELLATION
- Due to the operational cost involved in digitization, payments are non-refundable once processed.
- In rare exceptions, if no scanning or pickup has occurred, cancellations may be honored. Email team-rusticgram@rusticgram.com for review.
TERMINATION
- You may delete your account anytime through the app.
- We may suspend or terminate accounts that abuse or exploit the service.
- If we terminate your account for violation of the terms, no refund will be issued.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law:
- Rusticgram shall not be liable for indirect, incidental, consequential, or special damages arising from use of the Platform.
- While we implement commercially reasonable safeguards for physical and digital assets, Rusticgram’s maximum aggregate liability shall not exceed the total amount paid by you to Rusticgram in the preceding six (6) months.
- Rusticgram shall not be liable for losses resulting from events beyond reasonable control, including but not limited to natural disasters, logistics disruptions, or third-party infrastructure failures.
GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of India. Any disputes shall be subject to the courts of Chennai, Tamil Nadu.
CHANGE OF TERM
We may update these Terms periodically. If changes are material, we’ll notify you through email or in-app. Continued use constitutes acceptance of the new terms.
